“We grew tired of seeing companies being misled with inadequate legal advisory or getting involved in foreseeable problems that could have been avoided in the first place by an integral analysis of root causes. Law is not a mystery to be unveiled by the select few but an organized set of knowledge, with predictable patterns and specific procedures developed upon logic principles as a direct result of society as an entity and its need to regulate its own existence”.

The idea that led to establish ELAN LEGAL in 2015 was inspired by our sense that quality legal advisory and litigation is required in a complex and highly convoluted legal system such as in Mexico. Although rigid in nature, Mexican laws and regulations change constantly and new acts and amendments are issued almost daily. Judicial criteria (highly dependent on jurisprudence) are not uniform throughout Mexican courts and a complex checks and balances and judicial review machinery mediates between federal and local powers.

Companies and businesspeople in Mexico constantly deal with these obstacles. Our raison d’etre is to help you navigate through the Mexican legal system and fulfill your objectives in Mexico. Lic. Elan González Álvarez

Elan has developed his expertise in foreign trade and customs, administrative and tax litigation, maritime and port law, foreign trade and immigration law, preparing writs and filing lawsuits against administrative and tax determinations issued by Mexican authorities and advising in import and export operations, international transactions, administrative resolutions, foreign trade audits conducted by Mexican tax authorities, customs procedures and participating in antidumping investigations before the Federal Administrative Federal Court, District and Circuit Courts, the Ministry of Economy and other administrative and government bodies.

Elan continues advancing his education. He has diplomas and qualifications such as: Chemistry (Havard University); Customs Law by the Asociación de Agentes Aduanales del Aeropuerto de México, A.C.; Tax Specialization by the Universidad Nacional Autónoma de México (UNAM); Diploma in Taxes and Maritime Law by Instituto Tecnológico Autónomo de México (ITAM), and is currently undergoing his certification in Finances and Accounting by the Instituto Tecnológico y de Estudios Superiores de Monterrey (ITESM) as well as in Artificial Intelligence by MIT.

Lic. María Teresa Ortega Lecona

María Teresa has participated in both private and public sectors and developed her expertise in administrative, tax, foreign trade, energy, constitutional, social security, and labor controversies.

María Teresa worked in the General Customs Administration from 1979 to 1988

She later joined INFONAVIT, directing the litigation department and collaborated with the tax authorities developing the first customs code as well as customs policies and training to tax and customs authorities, thus acquiring experience in customs procedures and tax litigation. She actively advises companies and notable individuals regarding their tax and administrative cases and advises local governments in public policy and electoral law.

Dr. José Manuel Vargas Menchaca

Doctor in Law
Universidad Nacional Autónoma de México

Mexican lawyer specialized in corporate, foreign trade and labor law as well as in international transactions and international commercial arbitration disputes. He is also a law professor with more than 32 years of tenure at the Universidad Nacional Autónoma de México and has been a visiting professor at different prestigious universities such as Instituto Tecnológico y de Estudios Superiores de Monterrey, Instituto Tecnológico Autónomo de México, Universidad de las Américas¸ to name a few. He is a Doctorate in Law and Masters in Law by UNAM, and has a specialization in Public Finance (summa cum laude).

Dr. Vargas Menchaca has been NAFTA Chapter XIX panelist and has advised the governments of Guatemala and Dominican Republic to draft their antidumping laws and the Asociación de Exportadores de República Domincana. He was President (2017-2019) of the International Trade Commission of the Mexican Public Accountant Institute and participated as Coordinator of the Trade Dispute desk for the Private Sector in the USMCA negotiations and the Pacific Alliance (2017-2019).

Dr. Rafael García Moreno

Doctor in Economics

After more than 20 years of profesional practice, Doctor García has specialized in advisory to businesses and companies in foreign trade, international taxation, antitrust and economic competition, cross border transactions and legislative lobbying in Mexico.

In 1998 he received a scholarship to participate in the Programa de Formación de Ejecutivos en Proyectos de Exportación of the Banco Nacional de Comercio Exterior, where he developed and supervised export projects for Bolivia and Colombia comprehending administrative, production and finance analysis and preparation of a viable business plan.

In 2000 he joined the International Trade Practices Unit as Subdirector of Damage Analysis for the textile, paper and wood industries, in charge of determining the financial and economic effects derived from imports in dumping conditions against the Mexican national industry. In 2006 he was promoted to Director of Damage Analysis and actively participated in unfair trade investigations in cases involving Venezuela and Chile and participated as negotiator representing Mexico before Peru to subscribe the international trade treaty between both countries.

Lic. Miguel Ángel Concha Fuentes

Miguel started his professional practice in 2010 in CHEVEZ, RUIZ Y ZAMARRIPA, S.C. where he collaborated until 2014. He then joined GARDERE, WYNNE SEWELL LLP (now FOLEY GARDERE LLP), providing advisory in foreign trade and customs, international trade practices, tax litigation, corporate and commercial law, and administrative petitions before the corresponding authorities.

He has participated in several antidumping investigations such as steel pipe originating from USA, Spain and India; steel wire rod imports from China, rolled steel roll imports from Germany, China and France, among others.

In recent years, he has advised companies in corporate and commercial transactions and represented clients in commercial litigation, joint venture negotiations and intellectual property controversies.

Lic. Manuel Mendoza Martínez

Manuel is a corporate, commercial, foreign investment, compliance, and notarial lawyer. He acquired experience after working as legal consultant for international companies located in Mexico City in the real estate, energy, IT, insurance, editorial, banking, and commercial industries.

He has worked as advisor in corporate and foreign investment audits, contractual negotiation, company incorporation, IT law, company restructure, financial advisory M&A operations, shareholder meetings, company governance and implementation and supervision of due diligence and compliance procedures.
